Course background

There is now a daunting amount of legislation covering data protection.

It will be five months since the Data Protection Act 2018 bought into UK law the General Data Protection Regulations (GDPR) and the Law Enforcement Directive (LED).

This course will provide an up to date digest of Data Protection legislation from the Local Authority perspective and in particular revenues and benefits work.

The objective of the course is to ensure that delegates are aware of their obligations and duties under data protection law so that they can act within the law and provide accurate advice to the public.

The course will take the local authority perspective and cover :

  • Current data protection legislation, (GDPR, LED, DPA 2018, PECR). Will
  • include the Digital Economy Act 2017.
  • Interaction of data protection with FOISA and SPSO requirements.
  • The data protection principles with a focus on the lawful basis of processing for Local Authorities.
  • Data Controller Obligations.
  • Data Subject rights and where those rights may be restricted.
  • Sharing personal information – an introduction.
  • Consent to sharing personal information.
  • A digest of the latest information from the Information Commissioner; including codes of practice

At the end of the course, delegates will have greater understanding of :

  • The importance of data protection to keep the delegate and their employer safe from legal challenge.
  • An understanding of the issues that arise in sharing personal information.
  • Where the statutory provisions may be found.
  • How to respond to the public on data protection matters.

The course will be led by John Harding.

John Harding retired at the end of 2015 after 30 years of administering Benefits and Council Tax in Edinburgh. He has extensive experience in Benefit and Council Tax appeals, setting up the Scottish

Appeals Practitioners Group within the IRRV.

He contributed to the implementation of the statutory complaints procedure under the Scottish Public Sector Ombudsman Act 2002 and managed Freedom of Information requests in relation to Local Authority administered Benefits and Council Tax. His experience has given him a deep

appreciation of the practical operation of Local Government legislation.

Since retiring he has set and marked the IRRV Council Tax Law exam in Scotland.
